Libertarian Prevails Over Poway School
Bond Proponents In Courtroom Battle
Court rules that false and misleading statements about
local Libertarian Party
members must be deleted from all official election materials.

Chalk one up for the good guys! San Diego County Libertarian Party
member Donna Tello
came to the defense of five of her party colleagues when she sued the
powerful Poway
school bond interests and forced them to retract "false and misleading"
statements in the
bond proponents' ballot arguments.
In honor of Donna's remarkable victory and of actor George C.
Scott, who passed away
on the eve of Donna's triumph, the following is an Anatomy of a Lawsuit.
Facts: The California Elections Code provides for the County
Registrar of Voters to include
in its election materials arguments concerning ballot measures.
These arguments educate the
voters about the merits and detriments of a ballot measure, and are
many voters' sole source
of information about the measure. The arguments and rebuttals
appear in the ballot materials
present at the polls and in the voter guides mailed to registered voters
before the election.
Five people, including the President of the League of Women Voters
of San Diego and the
Executive Director of the San Diego County Taxpayers Association, signed
the argument in
favor of the Poway Unified School District's $149M bond measure, titled
Proposition A,
set for a special election on November 2, 1999. These same people
also signed the
rebuttal to the argument opposing Prop. A.
Libertarians Ed Macomber, Steve Green, Dr. Doris Ball, George Ball,
and Edward Teyssier
signed the argument opposing Prop. A, as well as a rebuttal to the
proponents'’ argument.
These people took a major risk in signing both arguments because they
could have been
ordered to pay tens of thousands of dollars in court costs and attorney
fees if they made but
one slight contextual or grammatical error and were, in turn, successfully
sued for making a
false or misleading statement.
(Steve Green, Edward Teyssier, and three other signatories to
the opposition argument in
last January's campaign against Proposition L were ordered by a judge
to pay approximately
$14,000 in attorney fees and costs for including a questionable statement
about library
standards in their ballot argument. The other side asked for
over $36,000!)
In their rebuttal to the Libertarians' opposition argument, the
bond supporters wrote the
following statements which were the subject of Donna's suit:
"There are a few things you should know about the people who
signed the ballot argument
against Proposition A:. . . None of the signers have visited the schools
or attended meetings
to see the condition of the schools. They are members of the Libertarian
Party who oppose
all school bond measures in the state regardless of needs or specifics.
. . .
We cannot get matching funds if Proposition A doesn't pass."
The Law: The California Elections Code provides that all proposed
ballot statements be
available for public examination for a 10-day period. During
this time, any voter in the
election’s jurisdiction may seek an order from a judge (by first filing
a lawsuit) to amend
or delete any language that is proven by clear and convincing evidence
to be false and
misleading. On the legal proof scale, “clear and convincing”
is a relatively high standard,
above “reasonable suspicion” (required for searches) and “preponderance
of the evidence”
(civil trials), but just below “beyond a reasonable doubt” (criminal
convictions).
California Code of Civil Procedure Section 1021.5, commonly called
the private attorney
general statute, authorizes a prevailing party in a lawsuit to collect
attorney fees from the
losing party if the suit enforces an important public right, the suit
significantly benefits the
public, and the award of attorney fees is necessary to get the plaintiff
to bring the action.
The statute enables parties who are interested in protecting an important
right, but
otherwise cannot afford an attorney, to secure one.
Lawsuits that cure false or misleading ballot statements qualify
for Section 1021.5's
attorney fees. A true “British system” law, if the plaintiff
loses in a Section 1021.5
lawsuit, he or she must pay the prevailing defendant’s legal fees.
This is the risk Donna
Tello took on in fighting the wealthy bond interests.
The Litigation: Ballot statement disputes are heard quickly
because the election
materials must be sent to a printer early enough to get the ballots
and pamphlets out
to absentee voters. Donna filed her suit on September 7th, the
parties had one week
to exchange written arguments, and the case was decided at a hearing
on September 24th.
In her written argument, Donna submitted declarations from Edward
Teyssier, and Doris
and George Ball that they had visited many of the Poway school and
saw the conditions.
All of the signers, except for Ed Macomber who was out of the country,
declared that
they were members of the Libertarian Party but they did not oppose
all school bond
measures in the state regardless of needs or specifics (e.g. they did
not necessarily
oppose bonds that did not raise taxes).
In their written argument, the bond supporters agreed to delete
their statement, “They
are members of the Libertarian Party who oppose all school bond measures
in the state
regardless of needs or specifics.” However, just before the start
of the hearing, the
Libertarians were dealt a severe blow when Judge Richard Strauss issued
a tentative
ruling against Donna on the two remaining disputed statements.
If the tentative ruling
stood, not only would the balance of the disputed ballot statements
stand, but this
would make the bond proponents the prevailing party, entitling them
to collect attorney
fees from Donna, probably around $15,000 to $20,000, and, of course,
denying
Donna’s attorney fees.
A judge makes a tentative ruling after reviewing the parties’
written arguments.
The parties can then make an oral argument to try and convince the
judge that the
judge’s tentative ruling was wrong - an almost impossible task.
However, Donna’s lead attorney, Bruce Henderson, in a well-reasoned
and
passionate hour and a half long presentation to the court, was able
to persuade
the judge to reverse himself and to find that the “None of the signers
. . .” statement
was indeed false and must be deleted. Ironically, the clear and
convincing evidence
came from State Assemblywoman and liberal Democrat Susan Davis’ office
-
a sign-in sheet from a meeting held at a Poway school to discuss the
bond measure,
signed by Edward Teyssier.
The statement about the importance of Prop A was allowed to stand,
but Donna’s
success on the other two statements allowed her to be the prevailing
party and to
move to recover her attorney fees and costs. But perhaps more
importantly, it sent
a message out to the public and to those in power in San Diego County
that the San
Diego County Libertarian Party will not be pushed around. And,
we can employ the
same legal remedy, formerly used against us, to defeat our opponents.
This case was a textbook example of how Libertarians can use
the courts, which
many of us distrust, to win our battles against those who greatly
outnumber and
outspend us in the political arena. Donna Tello and The Tello
Five are to be
congratulated for taking considerable risks for themselves and for
their families to
secure a great victory for the San Diego County Libertarian Party.

I want to thank all who have decided to run for office. In September
most of
our candidates attended our Executive Committee meeting, and I cannot
help
but be optimistic. In the last presidential election with an
early primary, it was
very difficult to find volunteers. Through the fantastic work
of our election
committee and the growth of the local Libertarian Party we have many
more
slots full earlier in the process. Still, we have a few vacancies
and we'd
appreciate volunteers to assure a full slate.
Partisan candidacies can be a great deal of fun. They give you
a chance to explain
our philosophy to many people at very low cost. Running for office
is one of the
most important things you can do for the advancement of liberty.
Of course, there are responsibilities, too. My advice to
candidates is to re-read
the Libertarian Party platform and program. You will be asked
many questions in
interviews and a clear understanding of Libertarian principles is a
must.
You should educate others on the differences between Libertarians
and either
conservatives or liberals. Some improperly view us as conservative
due to our
economic stands; others improperly view us as liberal due to our stands
on
personal civil liberties. Neither view is correct and there are
many who wish to
box us in the static right-left line. Giving voters the diamond-shaped
Libertarian
test helps them visualize all of the possible political views.
Others will tell you that we should "adapt" to what is popular.
The line goes:
"If you were to change your stance on _______ (fill in the blank),
you would be
more popular and have a better chance to win". Of course, this
is nonsense.
The reason to have a political stand is because it is the CORRECT stand,
not to
win popularity contests. We leave popularity contests to the
statist Demopublicans.
Sell your candidacies to open minded, thinking individuals.
Forget about those
that will only join if we change our principles. That doesn't
mean that you shouldn't
offer our views to all; but it does mean that your best sales pitch
is to people looking
for a coherent, principled philosophy. We are not moderates in the
political sense of
the word, but in a country where many people feel left out of the two
major parties
because they are economically conservative and socially liberal, we
have an
opportunity for great advancement. When people view us in that
way, we often
seem "moderate" and quite acceptable. But we have principles
to boot!

Hellhole Canyon

Hellhole Canyon isn't nearly as bad as it sounds. We'll be hiking
along an
abandoned portion of the Escondido Canal (actually an aqueduct), and
then
possibly to a mountain overlook. The place has added a few trails since
we
last went there in May of 1994.
DIRECTIONS: Take I-15 north to Escondido, and then route S-6 east
to
Valley Center. Turn right on Woods Valley Rd., which becomes Paradise
Mountain Rd. when it crosses Lake Wohlford Rd. Follow Paradise Mountain
Rd. about 3.5 miles to a five-way intersection with Los Hermanos Ranch
Rd.
and Kiavo Dr. Go north (roughly straight ahead) 0.5 miles on Kiavo
Dr. to the
Hellhole Canyon Open Space Preserve (Thomas 1091 H3).
The nominal starting time is 10:00 AM. I will be at the parking
area by 9:45,
and at 10:15 we will hit the trail.
There will be the usual optional meeting at an ice cream parlor
after the hike.

Hello one and all, my name is Michael Benoit. At the last Business Meeting
for the
San Diego Libertarian Party in September, I was elected the of Membership
Chairman.
I suppose it is obvious that my main function is to work on increasing
the membership for
our local party. That is what I intend to get busy doing.
You have seen some projects
come down the line that I have had an involvement in; the magnetic
signs, the quiz cards, etc.
I wonder, have you ever thought like I have in the past?
Thoughts like it is hopeless, that
people in this country are so dumbed down that they will never get
it? Have you ever
thought that most people do not want freedom? Have you ever thought
that too many
people are receiving benefit from government for us to ever be able
to turn the tide back?
Have you ever thought that the one party scam in this country, is controlling
the political
process to our exclusion?
Well I do not have delusions that we will right the Ship of Freedom
overnight, or even
that the Libertarian Party will become the majority party, any time
soon. I do believe we will
start electing people to higher offices, and that our voices and policies
will start being heard.
I do have a dream, that we get 10 % percent of the people proclaiming
and I mean loudly,
the message of Self Government. That this Nation will rise up
to live out the full meaning of
it's creed; that all persons, have an unalienable right to life, and
no one can take a piece of
your life and give it to someone else. That we can get 10 % of
the people to say not only no,
but hell no! This is enough to turn the tide back to limited
government, if we insist.
I keep thinking about the words many others have said about freedom
and the price you
must pay for it; there was "eternal vigilance", others have said responsibility.
Vigilance for
what, or to what, responsibility to what or for what? Ah I got it,
to be eternally vigilant is to
take responsibility for destroying the ugly head of tyranny whenever
it rears up. That is how
we win freedom.
I read recently where "slavery is freedom from responsibility".
That is pretty powerful when
you think about it. Remember that insanity is when you are not
responsible for your actions.
So it would seem the more you are made to be responsible for others,
as in a socialist country,
the less sane you are, and the less free of course. In America
we have those dependent on the
Government for survival. Of course that means dependency on the government
gun which
confiscates the production of another class of slave. So if the
dependent person is not
responsible for his existence, he is enslaved to that degree, and those
who are made to toil
for him are enslaved also. Then where are the free people?
So what can we do? Well we can organize and grow, and
as we grow we educate against
the government propaganda. We proclaim that theft is wrong even
if the government does it.
We bring to our side one by one, those people who can be awakened to
the fact that America
has gone astray, because it has subscribed to the philosophy of theft,
marxism, socialism,
communism call it what you like. It is not the America guaranteed
in the Constitution.
I now ask for your help to build our party numbers. I am asking
that you take some
responsibility in that regard. I ask for small amounts of effort
from all who wish to be free.
What I have in mind now is to divide the county into five sections,
with Membership Vice
Chairs in each section, and to find five additional leaders for each
of those five sections.
People who are willing to work a couple of hours a month on projects
to keep our numbers
up and growing. Much of the work can be done, in fact most of
it, from your home.
When you give up a value for a principle you will end up with
both, when you give up a
principle for a value you will end up with neither.

PLAN FOR BLACK'S BEACH BARED
Nudity has been commonplace at Black's beach (a secluded area North
of San Diego)
for decades. A long-ignored ban on nudity will now be enforced. The
crackdown (pun
intended) on public nudity was prompted by complaints that male exhibitionists
have
been harassing women.

GOOD NEWS: AN UPDATE ON HAIR BRAIDING
California sting operations have targeted what the government obviously
believes is an
sinister threat to the public order: African-Americans braiding hair
without a
cosmetology license. Fortunately, a U.S. District Court has just declared
the reasoning
used to justify such enforcement actions unconstitutional. The court
ruling probably
means that someday SaBrina Reese will be able to run her business without
fear of
harassment. Last year, the state cosmetology board sent two people
to her shop to
entrap her for practicing cosmetology without the required 1,600 hours
of schooling
and a license. The problem is that there is no cosmetology school offering
instruction
in Ms. Reese's non-chemical hair-braiding technique. Nor is it on the
licensing exam.
Ms. Reese faced a possible one-year jail sentence after being busted.

MY DISABILITY: BEING A DRUNK
A high school basketball star who was dripped from the team for drinking
says he is
a recovering alcoholic. He is suing in federal court for $100,000.
in damages and
position on the team under the Americans with Disabilities Act.

LATER, SCULLY
Hungary's Supreme Court has prohibited the state-owned television station
from
airing the "X-Files" show before 11 pm, saying the sci-fi mystery harmed
children's
mental health. It is one of Hungary's most popular shows.

U.S. OFFENDERS REACH RECORD 5.9 MILLION
The number of U.S. adults behind bars or under police supervision last
year reached
a record 5.9 million offenders, almost 3 percent of the adult population,
the Justice
Department reported. The figure, in a report issued by the department's
Bureau of
Justice Statistics, means that about one out of every 34 adults were
in the nation's
prisons and jails, or on probation or parole for various criminal acts.
This correctional
population represents an increase of 163,800 people from the previous
year. "It's
been a steady increase since 1990," according to Thomas Bonczar, a
co-author of
the bureau's report.

UNIVERSITY WORKS TO CREATE KILLER FUNGUS
A civil rights lawsuit has been filed by Montana NORML against Montana
State
University at Bozeman to retrieve all documents possessed by researchers
there
on the development of a mutant fungus that would destroy all plants
in the cannabis
family. "I think Montanans and indeed all Americans will be shocked
to hear that a
crop-killing fungus is being genetically engineered and tested in our
communities,"
said Montana NORML Director John Masterson. The fungus, known as fusarium
oxysporum, is the same strain that Florida state drug czar Jim
McDonough wishes
to use in his state to eradicate cannabis plants, despite claims that
the fungus could
be harmful to the environment.

TOXIC TORTS BY GOVERNMENT
Thousands of workers in federal uranium-enrichment plants in Kentucky
and
Tennessee have been exposed unknowingly to lethal doses of plutonium.
Although the workers took precautions against excessive exposure to
radioactive
uranium, they were unaware of the presence of plutonium at the plant.
(Plutonium
is about 100,000 times more radioactive per gram than uranium and can
cause
cancer if inhaled in microscopic amounts.) U.S.Department of Energy
officials
said it is now clear that uranium workers were not properly protected
until at least
1990, when new safety guidelines were implemented.

SCHOOLS LOBBY FOR PORK
The current foreign aid bill earmarks $1.5 million for two agricultural
programs at
American universities. Since 1980, Universities have obtained more
than $7 billion
through provisions tagged on to non-education spending bills - such
as the foreign-
aid bill mentioned above.

NO DRUG LINK TO FAMILY IN FATAL RAID
The El Monte Police Department has no evidence that anyone in the family
of Mario
Paz, a 65-year-old man fatally shot in the back by an El Monte officer
during a search
of his home, was involved in drug trafficking. Paz was shot to death
in full view of his
wife, Maria Luisa, by an officer who entered their bedroom during the
raid.

WACO: ROUND TWO
The admission that the FBI did fire pyrotechnic devices on the last
day of the 1993
siege at Waco should provide a final chance to find out what really
happened that
day. Congress seems intent on holding Attorney General Janet Reno to
her promise
of a fully independent review of the evidence. But what is happening
does not inspire
much confidence. A plan to dispatch 40 FBI agents to re-interview everyone
present
that day is sure to produce conflicts in recollections that will never
be resolved. Much
better would be to seek out all contemporaneous documents and any physical
evidence
that might be had. A good first priority would be to settle once and
for all what the
U.S. Army's secret Delta Force anti-terrorist unit did the day the
compound burned.

Help Wanted
CROSSROADS OF THE WEST DEL MAR GUN SHOW
The next gun show is less than a week away (Oct. 9-10).
It is hoped that those
of you who have done such a fine job in the past will find the time
to help staff the
show again. In terms of effectiveness, there is much to say for continuity.
Customarily, we staff the show with three Libertarians per half-day
shift (total of
four shifts), allowing two at the table while one (or two) roam throughout
the crowd.
This has worked well. We purchase extra vendor passes in advance
and offer
parking-cost-free shuttle service into the show. The last time, most
everyone gained
entry with no out-of-pocket expense whatsoever. While it does
require some work-
like tension, the gun show experience is basically entertaining, enlightening,
fulfilling -
and free for volunteers who so choose.
Once our primary need for twelve commitments to four shifts are
met, any number
of additional volunteers may later choose any time that suits personal
schedules for
the moment. It is open. You can do some work for Liberty, strike
against
Authoritarianism - then enjoy the show. Come on out!

facet of government which coincides with Libertarian principles. Here

from the various
periodicals. Phyllis Avery has been doing this for the North County
Times, but she
has asked for a replacement. We need this done for the Union Tribune,
La Prensa
and any other papers in San Diego County. Thomas R. Stott has taken
charge of
creating and adding to a database of the names from the clippings.

will produce the mailing labels.

Speaking of winning lawsuits, the big article this month (9/89) was
the "Chairman's
Report. In September we had just won the first hearings of Rider, et.
al, v. San Diego,
et. al. only a few months earlier. We didn't yet know how it
would turn out or what
we'd still have to do for final victory.
CHAIRMAN'S REPORT: Then-Chairman Dick Rider wrote about the sales
tax
lawsuit that was won just a few months earlier in 1989. ("Richard"
Rider used to
known as "Dick" Rider, but that's another story!)
"....[Judge Burkhardt] ruled that the county should return all
the illegally collected
sales tax through a temporary reduction from 7% to 5.5%. When
all taxes were
returned, the tax would go up to 6.5% level....."
Whoa! We WISH it was still 5.5%!
"...This case is a landmark decision that will effect attempts
by many local
governments throughout the state to bypass the 2/3 vote
requirement of Prop. 13..."
He was very good at predictions back then, too! Today, Rider
V. San Diego is
every tax-and-spend politician's nightmare.
"...Arrayed against us will be numerous county
and municipal governments filling
briefs on behalf of San Diego County...""...Now the bad news - this
appeal will cost
money. So what else is new? Yes, the government can fund their
efforts with stolen
money through taxation, but we can only rely on voluntary donations...""We
have
won too important a victory to let it slip away on appeal. It's time
to put some money
on the line....Let's demonstrate to the establishment that the we do
more than TALK
about liberty - we are willing to put our money where our mouth
is."
Liberty is never "free"! But Rider stuck with it and fought
every appeal up to the
California Supreme Court...and WON!. It truly is a landmark case!

The signatures must be of Libertarians who are registered to vote
in the
district in which the candidate is running.
Around October 14, you will receive an envelope in the mail containing
instructions and petitions for your signature.
Per the instructions, please sign both the front AND BACK in the
spaces
provided. Then get all the other Libertarians in your house &
neighborhood
to sign too.
Without your signatures our candidates will have to pay steep filing
fees or,
in some cases, won't be able to run at all!
Put Libertarians on your ballot and a grin on Liberty’s face
by signing and
returning those petitions today! Thanks!
